        INDEPENDENT ACTIVIST FILES DISBARMENT AGAINST CONTROVERSIAL FORMER WASHINGTON STATE U.S. DISTRICT ATTORNEY MIKE McKAY

CLAIMS OF BI-PARTISAN SUPPORT FOR McKAY CHALLENGED

Seattle, Washington, April 16, 2007:  Claiming a conflict of interest activist/small businessman Douglas Tooley today filed a disbarment action against Former U.S. District Attorney Mike McKay over his review of fraud claims in the 2005 gubernatorial contest.  Mr. Tooley argues that although evidence of outright election fraud may not exist, the manipulation of a poorly managed elections office until the desired result is reached benefiting another member of the legal profession is completely unacceptable.  Central to his argument is the fact of the legal professions responsibility in regards to the efficient administration of our election process and the clear evidence of failure in that regard.

Problems within the King County Elections Office, where fraud was alleged, are well documented in the local press.

Mr. Tooley is a Bush critic, but believes it within his abilities to select an Attorney capable of following orders and that U.S. Attorney General Gonzales is such a competent member of the profession.  Mr. Tooley’s politics are independent, but lean to the left.  He was a supporter of Republican Candidate Dino Rossi in the contested gubernatorial race, a ‘Dinocrat’.  His business practices are progressive and rooted in his college days promoting legally and financially responsible divestiture from South Africa.

 

Mr. Tooley states:  “It is time for the independent citizens of this country to rise up and become the ‘third branch’ of American politics by holding both parties accountable for their actions.  A centrist middle ground built on complacency and a splitting of the proceeds from the American Taxpayer is not acceptable.”  “Accepting mistakes only when they benefit another member of the profession is grounds for removal from the legal profession as they are officers of the court and subject to Constitutional requirements.”

  Mr. Tooley argues that although U.S. Senator Patty Murray is attempting to portray a high minded ‘bi-partisan’ attitude in her defense of McKay her motivations appear to be darker in nature relating to the legal profession.  Most notable in this regard is her recent refusal to return contributions from felonious Republican lobbyist Jack Abramoff.  Mr. Abramoff criminal actions were undertaken while under the employ of Washington State powerhouse law firm Preston, Gates, and Ellis, also a Murray supporter.  PGE has not yet been held accountable for their involvement in these actions, stating in the Wall Street Journal that ‘We were acting on the best interests of our clients’.

Mr. Tooley expresses no opinion on the other 7 U.S. Attorney firings, other than the observation that the firing of the Attorney investigating the corrupt Republican Cunningham of San Diego merits action of some sort.
